What happens when our bills are more than we make but our gross monthly income is over the median amount? We have three people in our family and it says that over a 6 month period we cant make more than $ 5400.00 is there an exception?

I have been dealing with this.
No, I have contacted many attorneys and they say
you have to do a Chapter 13. The attorney will have to do a means test, and tell you what you have to pay over a 3 or 5 year period. I don’t have any money left either.
They will tell you what your state allows for expenditures.
It is what it is.
Some attorneys said I can try to get you below the median because you don’t have any income left, and than you go there and they say, “you are over the median, you have to do a chapter 13.
Our income got cut in half and we have to wait 3 more months before we file because they divide your income by six months like you said. It really is crazy. I will have to pay less on my mortgage, risk foreclosure, or pay the creditors a smaller amount to hold them off so they don’t garnish our wages. In three months we have to file Chapter 13.
We still will have to pay creditors because of the crazy small amounts they allow for expenditures.
Call some lawyers in your state. I ended up contacting my state government, and they couldn’t even answer the question. They had to refer me to an attorney.
